My ex partners new boyfriend has taken a photo of his 10year old daughter with my 6year old son and my 7year old daughter, posted it on his Facebook and written beside it 'our beautiful kids with, and my ex partners name.  Is he out of order?  Does he need my permission to post pictures of my kids on his Facebook?  Is he breaking the law?  I have parential rights as my name is on their birth certificates.  What can I do to stop him doing this?

Hello Lorry. This is a tough one

He is not breaking the law as no one owns the rights to the pictures (they are not copy right etc) does he live wth your children/ex children?  

I can see why you are upset but just think it could of been worse, it would of been HIM and your children in the photo, if anything it's nice that his & your children get along but I think he should of stopped to think before he posted the picture on Facebook..

What's your situation like with your ex? Maybe you could have a friendly word with him or your ex and explain that you are not happy with this.

I am not a lawyer but it does not sound as if he has broken any law. He has called them "our beautiful kids"...which they are in one sense, HIS daughter and HER son and daughter. The images are not indecent so no grounds for complaint on that score, and presumably you have no concerns in terms of him being violent or a child abuser.

Anyone who knows you will KNOW they are your children, and anyone who does not know you can't think anything as they don't know you anyway.

I understand totally where you are coming from, it is almost as if he is claiming them as his (and that hurts) but it would be unrealistic for every separated parent to have the power to forbid their child ever to have a photo taken by someone other than the biological parent.

Do you see your children, Lorry? Time with them is far, far more important and special than this incident.
