Hi, I purchased a house 15 years ago with my ex partner (not married at the time) for £45,000 we split 11 years ago after 6 years of marriage, i live in the house with my three teenage daughters the youngest is 14, i have paid the mortgage ever since purchase and continue to do so, on my own, however when we went to court 11 years ago he was granted 33% of the sale of the house, which would be when my youngest is 18, 4 years time, this doesn't seem fair as he hasn't paid a penny towards it, but will reap benefit from the sale - is there any way I can get this changed, or appeal, the house is now worth around £220,000? I still have 8 years on the mortgage.  He is a very horrible man, pestered me to sell the house sooner so he can have 'his money'. This doesn't seem fair that he gets the chunk of the profits from sale of the house in 4 years time and he has paid nothing towards, why is it not from the price we paid for it and is there anywhere I can go to get this changed and fairer? Please help. Tania

Hi Tania

Welcome. You need some legal advice. Email our legal expert here.

I was in exactly the same position as you, and my boys' dad was granted 25% of the equity in the house and when it came for me to pay it, I had to add that amount to my mortgage to pay him off and like you, that 25% was actually DOUBLE in money terms from the amount I would have had to pay if I done so at the time of the separation. I would be surprised if you can get it changed but see what the solicitor says.

Hi

I paid my ex off in the beginning. It still cost me over £29k. My house only cost me £35 but was worth £120k at the time of divorce and there was no way i was losing ot when my children became old enough.

He moved in to my house paid nothing and moved out with a nice lump sum. All I can say is, it was worth every penny.

I know its a bit late for you now but I wish you good luck and hope you get it sorted x

Those are dead dangerous! I wouldn't go near one with a bargepole!

How quickly would someone be on that downwards spiral....
