Has anyone any experience of a Father without PR applying to the courts to obtain it? If he hasn't had anything to do with the child for 9 years, would that go against him is what I'm trying to find out really. I have been researching, and found this: If courts do take the following into consideration, then surely C's father wouldn't be granted PR would he?

Applying to the courts for parental responsibility

A father can apply to the court to gain parental responsibility.
In considering an application from a father, the court will take the
following into account:

  • the degree of commitment shown by the father to his child
  • the degree of attachment between father and child
  • the father's reasons for applying for the order

The court will then decide to accept or reject the application based on what it believes is in the child's best interest

Yes the court will do that, Hazeleyes but the research you have read is more to do with someone OTHER than the biological father applying for PR, such as a step-parent. In any case, whether the biological father got PR or not, he could still apply for contact with the child.

I'm probably making a big fuss out of nothing, but where C is concerned, I will do anything. Do you think I should go for full custody or do I already have that? Totally in the dark here really about this sort of stuff. The other thread has got me thinking really hard.

You don't have full custody as such because C's whereabouts has never been a legal question....you were not married to his biological father and his residence has never been through the courts. If you start an action now, I would have thought that one of the things that would happen would be that the other parent would have to be involved in the action...just what you don't want. At the moment you have automatic Parental Responsibility, as the mother.

However, H, if you would like to run that past the legal adviser then I think that would be a good idea, just to check what the procedure would be Smile (here)

Keeping fingers firmly crossed that he's offered another job.

All in a dither. Sole and physical custody is what I'll aim for if I don't have to involve him with it all. I could always say I don't know T's whereabouts, and lie through my teeth. I do remember years ago ringing someone up (can't remember who) but it was something to do with the custody thing, and they said if he wasn't in the country then he wasn't a threat. God, it was so long ago now, I cannot remember half the stuff that was said.
