I have been claiming single parent child tax credits since my ex and I separated back in 2010.

I was investigated for fraudulently making a claim last year by the inland revenue. The reason this happened was my ex was taking out loans and using my address. I went through the process of returning all his mail to sender, got in touch with credit agencies to disassociate myself from him financially and spoke to him telling him not to use my address anymore (this was the advise given to me by the IR). The IR closed the case but told me they would automatically open it agian in the new financial year. If the activity had continued they would be questioning me again.

So, thats where I am now. He has continued to use my address even though I spoke to him and he promised he would stop.

This time the IR have cancelled my tax credits altogether and have stopped sending me money. Again I have managed to sort it out with them but I will have to reapply for my tax credits and wait for the money to start again. They have also told me that if the activity continues over the next 12 months the invetsigation will be more involved and I will need to provide evidence that he doesn't live with me.

So my question is....How can I stop him? It doesn't affect him and he obviously has no intention to stop. I've spoken to the CAB today and they said there is little I can do, apart from the things I have already done.

This really is a thorny one, pq. I'm glad you've managed to convince the IR to allow you to start a fresh claim, but that doesn't help you in the meantime. You seem to be doing all you can but without much joy.

If your ex is carrying on regardless, it sounds as though this is a legal matter because he is fraudulently using your address. I'd urge you to consider contacting One Space's legal advisor and/or consulting a solicitor.

I have sent the question to the legal advisor, however I noticed I sent a similar message last year, so not sure I will get much different back.

Its so frustrating.

I totally understand your frustration.

It might seem drastic, but it might be time to bring in a solicitor. I do hope you can get this situation sorted out very soon.

The CAB recommended I contact one which does a fixed fee for half an hour, just to get some facts and information. I'll wait and see what the legal advisors says first. However it does look like there is very little I can do.

Of course I am not a legal expert but surely he is committing an offence by fraudulently using your address? I was hoping that a stiff solicitor's letter might do the trick. In the meantime ANY letter that comes for him, however seemingly harmless, put it back in the post box marked "not at this address" In order to obtain credit he must, however, be supplying "proof" that he is living at your address. This will cut it off if there are no official letters to him with that address on. The other thing is his driving licence...could it still carry your address? if so then it is worth mentioning to him that this is an offence carrying a penalty fine of £1000!!!!! See here

Also make sure when you get the Register of Electors form in the spring that you send it off showing you as the sole adult resident, as firms giving credit will often check the electoral register
