Hi Ladies,

I would love your feedback regarding a long standing issue with the C.S.A.

In the beginning my son's Father would pay £5.00 per week through the C.S.A. However this stopped after a year when he submitted his books (hes self employed).

He states he only earns £50.00 per week as a PGA Touring Golf Professional and Instructor. The C.S.A. have said there's little they can do, as when they have taken his other two Son's who incidentally were born after our Son in to acccount- he doesn't have to pay under law anything to his first born. I have given information to prove lifestyle inconsistent with earnings in the past and still the same result, I now learn he's moved into a larger house, hmmmmm funny he can do that on his earnings.

Can you think of any way round I can attempt to improve my chances of getting this b*gger to pay something???

Many thanks for coming back to me. He sure has covered is bases, and short of travelling down to Hereford to ram a nine iron in a place where the sun don't shine, I'm really at a loss as to what my next move is.........

This needs a bit more information and discussion.  the CSA will take his earnings from self employment from his tax returns. It is an easy option for them and lawful .

Is it more than 28 days since the new assessment was made? If it isn't 28 days since the new maintenance assessment was received, then you should ask for a revision on the grounds that you do not think the income used is correct. This won't make a massive difference at this stage but will give you the opportunity of an appeal if they refuse to revise. Do it immediately so you are wiithin the time limit of 28 days.

Have you actually requested a variation?  Have you had a formal refusal to apply a variation?  They have to formally refuse and the date of the refusal gives you another 28 days to appeal. 

Phone the CSA and tell them that you want to appeal their decision to not apply a variation and ask for an appeal form.   Unless it is a long time ago, you can usually ask for the time llimit to be set aside.  Make a note of the date, time of the appeal request. 

There are lots of things you can do to argue lifestyle inconsistent with income but i prefer not to put it in an open forum.  The last thing I want to do is help people reduce/evade their child support.  What I would like you to do is write to me via the one to one advice service and then we can have an open frank discussion in confidence.

If you do write to us via one to one advice; I just need to say that I would like to respond to it rather than Debbie if you are agreeable to this but I am on holiday from today until 26th July .

I am not saying that you will make him pay more, because self employed people are very good at disguising their income but we will have a good shot at pointing you in the right direction if you allow us to.

HI there,

 

I have only joined this website today and can see how wonderful your help is. I ahve recently become single and the father isn't giving me a fair amount of money, He has givEN ME £160 IN 4 MONTHS FOR MY 3 GIRLS, one who is 3 and the twins who are 2. Some months he earns £200 other months he earns 4k also i have no address for him so how would he be traced?? he has avoided thousands of pounds in debt in the 9 yrs i ve known him and never got caught so is there any point in chasing him? Please help!!!!
